               A LOCAL LAW ADDING A NEW CHAPTER

 

               LOCAL LAW NO  6  OF THE YEAR  199  

 

                      VILLAGE OF MINEOLA

 

  A LOCAL LAW ADDING CHAPTER  16  ENTITLED  "SNOWPLOW OPERATORS"  TO THE VILLAGE OF MINEOLA MUNICIPAL CODE.

 

  BE IT ENACTED by the Board of Trustees of the Village of Mineola, New York as follows:

 

  SECTION 1. ADDING CHAPTER  16  ENTITLED "SNOWPLOW OPERATORS" TO THE VILLAGE OF MINEOLA MUNICIPAL CODE.

 

  A new Chapter to be known and designated as Chapter  16  entitled "Snowplow Operators"  to follow Chapter  15  is hereby made a part of the Village of Mineola Municipal Code to read as follows:

 

                          "CHAPTER 16

 

                      SNOWPLOW OPERATORS

 

§ 16.1  Definitions

 

  As used in this Chapter, unless the context or subject matter otherwise requires:

 

  1.  "Snowplow operator" shal lmean a person who offers to the public to remove snow or ice from sidewalks and driveways of public or private premises with motorized snowplowing equipment.

 

  2.  "Snowplow equipment - motorized" shall mean a snowblower, snowthrower, garden tractor with blade or blower attachment, a regular tractor, a pick-up-truck with blade or other device designed and intended to be used for the removal of snow or ice.

§ 16.2  License required; exception

 

  A.  Restrictions.  No person over the age of sixteen (16) years of age shall offer to remove snow, ice or other accumulations.

§ 16.10  Penalties

 

  Any violation of this Chapter shall constitute a vioaltion pursuant to the Pneal Law but in no case shall the fine imposed exceed Two Hundred Fifty Dollars ($250.00).

 

SECTION 2. UNCONSTITUTIONALITY OR ILLEGALITY.

 

  If any clause, sentence, paragraph, word, section or part of this local law shall be adjudged by any court of competent jurisdiction to be unconstitutional, illegal or invalid, such judgment shall be confined in its operation to the clause, sentence, paragraph, word, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.


 

  SECTION 3.  EFFECTIVE DATE.*

 

  This local law shall take effect immediately  [on January 1,

 199 ] after filing in the Office of the Secretary of State.

 

  [b.  Subject to permissive referendum:]

 

  This local law shall take effect upon its being duly filed in the Office of the Secretary of State subject to the provisions of section twenty-four of the Municipal Home Rule Law.

 

  [c.  Subject to mandatory referendum:]

 

  This local law shall take effect upon approval by the electors of the Village of Mineola at the general  [or special]  election to be held on  November 7, 199  and filing in the Office of the Secretary of State.

 

 

 

 

 

 

 

 *Unless the effective date is specified, the local law shall take effect on the twentieth day after final adoption.  Mun HRL § 27(4).

 

**This particular local law does not require a referendum but the following alternative provisions are provided to set forth the form to be used where a referendum may be required.
