ENFORCEMENT
OFFICERS
§ 3.1 Title
This
Chapter shall be known and may be cited as the "Enforcement Officers Law
of the Village of Mineola, New York".
§ 3.2 Establishment
of Department of Building and Code
Enforcement
A. Establishment.
There is
hereby established in the Incorporated Village of Mineola a department to be
known and designated as the Department of Building and Code Enforcement.
B. Department head; deputies.
The
Superintendent of the Building Department shall be the head of the Department
of Building and Code Enforcement. There
shall be such deputies, assistants and employees as may be authorized by the
Board of Trustees and appointed by the Mayor subject to approval of the Board
of Trustees. [§ 3.2 amd. LL #13, 96; 10/16/96 by designating the Superintendent
of the Building department as head of the Department.]
§ 3.3 Powers
and duties
A. The Department of Building and Code
Enforcement through its duly qualified officers and employees shall enforce the
following Chapters of the Village of Mineola Municipal Code:
1. Chapter 15 - Licensing and Regulation of
Businesses.
2. Chapter 17 - Peddlers and Solicitors.
3. Chapter 18 - Secondhand Dealers.
4. Chapter 23 - Taxicabs.*
5. Chapter 24 - Tow Cars.
5. Chapter 26 - Uniform Code Enforcement.
6. Chapter 27 - Housing Code.
7. Chapter 29 - Plumbing.
8. Chapter 30 - Zoning.
9. Chapter 32 - Environmental Quality Review.
10.
Chapter 33 - Unsafe Buildings.
11.
Chapter 35 - Swimming Pools.
12. Chapter 44 - Streets and Public Places.
*Chapter 23 repealed. See Chapter 52, Taxicabs, etc., LL #16, 96,

other state statute, local law, rule or regulations as may be assigned to this
Department by the Board of Trustees or by operation of law.
B. Parking Violation Enforcement Officers.
1. There shall be such number of Parking
Violation Enforcement Officers as may be authorized by the Board of Trustees
and appointed by the Mayor subject to the approval of the Board of
Trustees. The Senior Building Inspector
shall supervise such Officers in the performance of their duties.
2. The Parking Violation Enforcement Officers
shall enforce all non-moving traffic regulations as established in Chapter 60
entitled "Traffic and Vehicles" of this Municipal Code and the
Vehicle and Traffic Law of the State of New York within the Incorporated
Village of Mineola.
C. Whenever the term "Enforcement
Officer" is used throughout this Municipal Code, it shall be deemed to
mean any of the designated officers or employees of the Department of Building
and Code Enforcement unless otherwise specifically provided.
§ 3.4 Authority
of Nassau County Department of Police
Notwithstanding
the foregoing, any police officer of the Nassau County Department of Police
shall be authorized to enforce any of the penal provisions of the Incorporated
Village of Mineola Municipal Code.
§ 3.5 Authority
of Superintendent of Public Works and his or her deputies, assistants and representatives
In
addition to the authority granted to the Department of Building and Code
Enforcement, the Superintendent of Public Works and any of his or her deputies,
assistants or representatives shall have authority to act as enforcement officers
of any of the chapters for which they are responsible to exercise supervision
or control.
