Minutes of the meeting of the Board of Trustees of the Incorporated Village of Mineola

held Wednesday, October 17, 2007 at Village Hall, 155 Washington Avenue , Mineola , New York 11501 .

A Public Hearing was held at 6:30 PM at the Village Hall, 155 Washington Avenue , Mineola , NY   11501 in order to receive public comment upon the following:

 

PROPOSED LOCAL LAWS AMENDING THE CODE OF THE INCORPORATED VILLAGE OF MINEOLA TO PROVIDE THE MAXIMUM BENEFITS AVAILABLE UNDER THE LAW WITH REGARD TO A SENIOR CITIZEN TAX EXEMPTION, A VETERAN TAX EXEMPTION, A DISABLED TAX EXEMPTION AND A VOLUNTEER FIREFIGHTER AND AMBULANCE CORPS TAX EXEMPTION.

Resolved to adopt the proposed Local Law for each tax exemption as presented.

A Public Hearing was held at 7:30 PM at the Village Hall, 155 Washington Avenue , Mineola , NY   11501 in order to receive public comment upon the following:

 

APPLICATION OF K & P REALTY HOLDINGS, LLC, FOR A SPECIAL PERMIT/DEVELOPMENT INCENTIVE BONUS, PURSUANT TO CHAPTER 30 OF THE CODE OF THE INCORPORATED VILLAGE OF MINEOLA ENTITLED  “ZONING”, SECTION 30.5 ENTITLED “APPLICATION OF REGULATIONS”, SUB-SECTION (A) ENTITLED “DEVELOPMENT INCENTIVE BONUSES”, FOR THE CONVERSION FROM RESIDENTIAL TO A LAW OFFICE USE IN AN R-3 ZONE UPON THE PROPERTY KNOWN as 228 HARRISON AVENUE, MINEOLA, NEW YORK, KNOWN AND DESIGNATED ON THE NASSAU COUNTY LAND AND TAX MAP AS SECTION 9, BLOCK 404, LOT(S) 809-811.

Resolved to designation this as an unlisted action under the State Environmental Quality Review Act with no significant environmental impact.

Resolution No. 261-07

 

 

WHEREAS, the Secretary of the U.S. Department of Housing and Urban Development is

Authorized under Title I of the Housing and Community Development Act of 1974, as amended, to make grants to state and other units of general local government to help finance Community Development Programs; and

 

WHEREAS, the COUNTY OF NASSAU (County) and VILLAGE OF MINEOLA (Sub recipient) entered in an Cooperation Agreement to participate in a Nassau County Community Development Program, for a term of three (3) years to commence the 1st day of October 2002 and end the 30th of September 2005, under Title I of the Housing and Community Development Act of 1974, as amended; and

 

WHEREAS , the Secretary of U.S. Department of Housing and Urban Development

has approved a Community Development Program for the 33rd Program Year, Federal fiscal year 2007; and

 

WHEREAS, pursuant to said Cooperative Agreement the COUNTY and the SUBRECIPIENT have agreed to undertake project activities using Community Development Block Grant Funds to be received by the COUNTY from the U.S. Department of Housing and Urban Development; and

 

WHEREAS, the Secretary of the U.S. Department of Housing and Urban Development has approved an application for Community Development Block Grant Funds, under Title I of the Housing and Community Development  Act of 1974, as amended submitted by the COUNTY and participating municipalities for the 33rd Program Year, Federal Fiscal Year 2007; and

 

WHEREAS, the Board of Trustees of the INC.VILLAGE OF MINEOLA, deems it to be in the public interest of the SUBRECIPIENT to enter into said proposed Agreement for the purpose of undertaking project activities thereto set forth, under Title I of the Housing and Community Development Act of 1974, as amended,

 

NOW, THEREFORE, BE IT RESOLVED, that Jack M. Martins, Mayor of the Incorporated Village of Mineola be and he hereby is authorized to execute an Agreement between the SUBRECIPIENT and the COUNTY OF NASSAU for the purpose of undertaking project activities under Title I of the Housing and Community Development Act of 1974, as amended, for the 33rd Program Year, Federal Fiscal Year 2007.

Resolved to approve the request by the Mineola Mustang Run Committee to set up a table in one of the classrooms at the Village Halloween Party on Friday, October 26, 2007 to distribute candy and promote the upcoming Mustang Run on November 18, 2007 .

Resolved to approve the request by the Corpus Christi CYO for the use of the Community Center Gymnasium for Basketball practice on Monday evenings from 6:00 PM to 9:00 PM , from October 22, 2007 through January 31, 2008 .

Resolved to approve the notice and advertisement in Newsday of the Public Hearing for the Proposed Homestead Tax Option scheduled for Friday, October 26, 2007 at 5:30 PM .

Mayor Martins requested a vote by the members of the Board to approve the Special Permit application of Kingdom Family Holdings, LLC, for the Construction of a 22-unit residential condominium, which was presented before the Board of Trustees on July 18, 2007 ,

 

Resolution No. 266-07

 

Resolved to approve the Special Permit application of Kingdom Family Holdings, LLC for the construction of a 22-unit residential condominium on the property known as 141, 147 Main Street , Mineola , New York .

Mayor Martins encouraged everyone to come out for “ Mineola in Style”, hosted by the Mineola Chamber of Commerce at the Jericho Terrace on October 23, 2007 . 

 

Mayor Martins announced that the Village would be hosting a forum along with Inspector O’Leary from the 3rd Precinct, on October 24, 2007 at 7:00 PM at Village Hall in order to address the Homelessness issues in our Village. 

 

Mayor Martins also announced that Mineola High School would be holding the rededication of their auditorium on October 24, 2007 .

 

Mayor Martins congratulated Charles and May Ann Ribando on being named “Italian American Couple of the Year” by the Knights of Columbus. 

 

Mayor Martins invited all residents to come out for the Village Halloween Party on Friday, October 26, 2007 at 7:00 PM at the Community Center. 

 

Mayor Martins discussed the legality of using Village funds for charitable donations.  Mayor Martins explained that charitable donations of  village funds is not legal.  Mayor Martins invited the members of the Board to speak to the issue; no one had anything to add.

 

Mayor Martins requested a motion to close the Public Meeting at 10:20 PM .
