Minutes of the meeting of the Board of Trustees of the Incorporated Village of Mineola held Wednesday, May 11, 2005 at the Village Hall, 155 Washington Avenue, Mineola, New York.

A Public Hearing was held at 6:30 PM at the Village Hall, 155 Washington Avenue, Mineola, New York, 11501 in order to receive public comment upon:

The discontinuance and conveyance of a strip of municipal land in Mineola, known as Station Road, specifically that section between 3^rd

and 4^th Avenues, more specifically described as:

Beginning at the corner formed by the intersection of the easterly

side of 4^th Avenue with the southerly side of Station Road;

Running Thence north 17 degrees 40 minutes 59seconds

west distance of 40.00 feet across Station Road;

Thence along the northerly side of Station Road (to be vacated)

north 72 degrees 19minutes 01 seconds east 395.63 feet to the

westerly side of 3^rd Avenue;

Thence south 17 degrees 40 minutes 59 seconds east a distance

of 51.70 feet across Station Road to the corner formed by the

intersection of the westerly side of 3^rd Avenue with the southerly

side of Station Road;

Thence along the southerly side of Station Road (to be vacated)

the following three (3) courses and distances:

1.) South 72 degrees 19 minutes 01 seconds

west a distance of 96.60 feet;

2.) North 21 degrees 50 minutes 35 seconds

west a distance of 11.73 feet;

3.) South 72 degrees 19 minutes 01 seconds

west a distance of 298.18 feet to the point or

place of Beginning.

A proposed Local Law Amending Chapter 30,Entitled “Zoning”

§30.102, entitled “Building Permits”, to add thereto subsections

(D) and(E) to provide that building permits may not be issued prior

to Planning Board approval in matters where such approval is required

and to provide for the reimbursement expenses incurred by the Village Boards in their review of applications.

Resolution No. 133-05

Resolution No. 134-05

Resolved to approve the proposed Local Law amending Chapter 30 entitled “Zoning” §30.102, entitled “Building Permits” to include subsections (D) and (E) to provide that building permits may not be issued prior to Planning Board approval in matters where such approval is required and to provide for the reimbursement of expenses incurred by the Village Boards in their review of applications.

Mayor Martins opened the Work Session at 7:30 PM.

Mayor Martins reported that Village Clerk Michael Arens had resigned and introduced Joseph R. Scalero as the new Village Clerk.

Resolved to approve the Village of Mineola’s continued participation in the Nassau County Urban Consortium.

Resolved to approve the Mineola Middle School’s request for the use of Mineola Memorial Park and the gazebo for “Shakespeare in the Park” on Wednesday, May 25, 2005 and Thursday, May 26, 2005 from 8:00 AM to 2:36 PM.

Mayor Martins discussed projects that were approved at previous meetings and that the Board of Trustees voted to finance Bond Anticipation Notes.

Resolution No. 137-05

Resolved to approve a 5-year BAN for $350,000 to finance the purchase of one (1) new sanitation truck chassis, one (1) 10-foot salt spreader, one (1) new 20 yard refuse loading body, one (1) new three-wheeled self-propelled street sweeper, one (1) new pick-up truck with plow and tail-lift and one (1) new truck body with scissor-lift central hydraulic plow for the conversion of a sweeper to a truck, or equivalent, including any original apparatus and equipment, and costs related and incidental thereto for use in and for the Village as previously approved by the Board of Trustees.

Resolution No. 142-05

Resolved to approve a 90-day limited reinstatement of the Special Use Permit issued to Nextel of New York for the installation of a Nextel cell tower at the location known as 250 Old Country Road, Mineola, New York 11501. Be it further resolved that the Board of Trustees is requesting that the applicant provide an update and explanation for any further delays in completion of this project.

Building Department Supervisor, Daniel B. Whalen asked the board for a resolution for the SEQRA determination for the Special Use Permit applicant, Doshi Associates, LLC, for the location known as 124-B E. Jericho Turnpike, Mineola, NY. Mr. Whalen explained that the SEQRA determination is necessary for the applicant to move forward with the Nassau County Planning Board as well as the Village’s Zoning

Board.

Village Attorney Mr. Spellman stated that this was an unlisted action with no significant environmental impact.

Resolution No. 143-05

Resolved to designate the action as an unlisted action with a negative declaration pursuant to the State’s Environmental Quality Review Act (SEQRA).
