Minutes of the meeting of the Board of Trustees of the Incorporated Village of Mineola

held Wednesday, April 15, 2009 at Village Hall, 155 Washington Avenue, Mineola, New York 11501.

Mayor Martins called the Work Session to order at 6:40 PM

Resolution No. 102-09

 

Resolved to authorize at the request of Robert Hinck, Community Development Coordinator, the issuance of a Request for Proposals from pre-qualified providers for engineering services for the Station Plaza North project.

Resolved to approve a request by the American Legion-Mineola Memorial Post No.349

for the use of the Village Hall Community Center Saturday May 23, 2009 from 9:00 AM

to 12:00 PM for parade preparations and to hold the Annual Mineola Memorial Day

Parade Monday May 25, 2009 at 11:00 AM (Rain Location: Community Center).

Village Clerk, Joseph R. Scalero announced that Summer Recreation applications are now available at Village Hall.

Drive Pick Up Truck for the Water Department.

Superintendent of Public Works Thomas J. Rini presented updates on the Horton Highway paving restoration project and on the Harrison Avenue (Field #5) parking lot re-paving. Mr. Rini also reported on Department of Public Works’ spring activities that are in progress within the village.

 

Village Attorney, John M. Spellman presented an overview on the Town of North Hempstead “Flow Control” ordinance.

   Resolution No. 106-09

 

BE IT RESOLVED, that the Board of Trustees hereby approves a Declaration of Exemption from Section 46-14, Subsections A-K, N and O of Article II of Chapter 46 (“Sanitation Code of the Town of North Hempstead”) of the Code of the Town of North Hempstead (“Town”).

 

            This Declaration of Exemption is made without prejudice to the position of the Village that the Town does not have jurisdiction over the Village with respect to the imposition of the requirements of its Code upon the Village and also without prejudice to the position of the Village that solid waste “flow control”, as purportedly implemented by the Town through its Sanitation Code, is illegal.

 

            In accordance with Subdivision B of Section 46-22 of the Sanitation Code, and without further prejudice to the position of the Village as aforesaid, the Village, through this Declaration of Exemption, hereby agrees to indemnify the Town and the Solid Waste Management Authority thereof from responsibility or liability under any New York State law, rule or regulation relating to solid waste collection, disposal or recycling activities conducted or authorized by the Village, including but not limited to New York State Environmental Conservation Law Section 27-0107 (“Local Solid Waste Management Plans”) and 6 NYCRR Part 360, Subpart 15 (“Comprehensive Solid Waste Management Planning”) to the extent that such indemnification is permitted by law.

 

            The Village Clerk is directed to communicate this Declaration of Exemption to the Clerk of the Town of North Hempstead.

Mayor Jack M. Martins announced that Mineola Fire Department Chiefs, Officers, and Wardens were recently sworn in and congratulated Robert L. Connolly as the newly- elected Chief of Department and Joseph Pratt as 1st Assistant Chief, and thanked  outgoing Chief Scott C. Holliday on a fine job serving as Chief of the Mineola Fire Department. Mayor Martins reminded everyone that the Annual Mineola Athletic Association (MAA) Parade is Saturday, April 18, 2009 starting at 10:00 am and suggested everyone come out and support them.

 

Trustee Lawrence A. Werther hoped everyone had a wonderful holiday, also congratulated Chief Connolly and 1st Assistant Chief Pratt and thanked outgoing Chief Holliday.  Trustee Werther commented that shortly Ray Sirkorski will be filling the position of President of the Mineola Chamber of Commerce, thanked Chamber of Commerce President, Steve Ford on a fine job over the past two years and reminded everyone to support the merchants within Village of Mineola.

 

Trustee Paul S. Cusato announced the passing of two former merchants. Trustee Cusato welcomed home Matt Doyle who is ending his tour of duty in Iraq and wished Mike Marotta a safe return as he starts his tour of duty.

 

Trustee Thomas F. Kennedy also congratulated Chief Connolly and 1st Assistant Chief Pratt and thanked outgoing Chief Holliday.
