IT RESOLVED, that the Board of Trustees hereby approves a Declaration of
Exemption from Section 46-14, Subsections A-K, N and O of Article II of Chapter
46 (“Sanitation Code of the Town of
This Declaration of Exemption is made without prejudice
to the position of the Village that the Town does not have jurisdiction over
the Village with respect to the imposition of the requirements of its Code upon
the Village and also without prejudice to the position of the Village that
solid waste “flow control”, as purportedly implemented by the Town through its
Sanitation Code, is illegal.
In accordance with Subdivision B of Section 46-22 of the
Sanitation Code, and without further prejudice to the position of the Village
as aforesaid, the Village, through this Declaration of Exemption, hereby agrees
to indemnify the Town and the Solid Waste Management Authority thereof from
responsibility or liability under any New York State law, rule or regulation
relating to solid waste collection, disposal or recycling activities conducted
or authorized by the Village, including but not limited to New York State
Environmental Conservation Law Section 27-0107 (“Local Solid Waste Management
Plans”) and 6 NYCRR Part 360, Subpart 15 (“Comprehensive Solid Waste Management
Planning”) to the extent that such indemnification is permitted by law.
The Village Clerk is directed to communicate this
Declaration of Exemption to the Clerk of the Town of
